Official Terms and Conditions for the ProSocial Video Promotion
1. Sponsor and Administration
1.1. This Competition (“Competition”) is promoted by ProVision Australia (“Sponsor”).
1.2. The Competition is administered by the Sponsor and is subject to all applicable federal, state, and territory laws and regulations in Australia.
2. Eligibility
2.1. The Competition is open exclusively to optometrist-owned independent practices who are registered and operating in Australia, excluding the Australian Capital Territory (ACT), and are members of Optometry Australia. For the purposes of this Competition, “independent” refers to practices who operate their practice independently and are not employed by or affiliated with a large chain or corporate entity. Proof of independent status may be required.
2.2. Entrants must be at least 18 years of age and an Australian resident.
2.3. Employees, agents, and contractors of ProVision Australia (and their immediate families or households) are not eligible to enter.
2.4. Limit of one entry per practice
3. Entry Period and How to Enter
3.1. The Competition commences on 24 March 2025 and closes on 25 April 2025 5pm AEST (“Entry Period”).
3.2. No purchase is necessary to enter.
3.3. To enter, eligible participants must submit their entry online via optom.provision.com.au/VideoPromo. Only one entry per eligible person will be accepted.
3.4. All entries must be received by the closing date and time. Late entries will not be considered.
4. Prize Description
4.1. The prize is a half-day videography package with Flabbergast, valued at $3590+GST (Recommended Retail Price).
4.2. The package includes:
• On-location videography using professional equipment, including high-definition cameras, microphones, lighting, and a drone (if applicable).
• An initial online meeting to discuss goals and vision.
• Development of a tailored shot list and storyboard aligned with the entrant’s vision.
• Two rounds of revisions to ensure the final video meets expectations.
• A brief discussion on leveraging the video content for maximum reach and engagement across platforms.
4.3. The prize is non-transferable, no cash alternative will be provided, and the Sponsor reserves the right to substitute the prize with an item of equivalent value should circumstances necessitate.
5. Winner Selection and Notification
5.1. The winner will be selected at random from all eligible entries received during the Entry Period.
5.2. The draw will be conducted by the Sponsor or its nominated agent, whose decision is final and binding.
5.3. The winner will be notified via the contact details provided at entry within 7 days following the closing date.
5.4. If the winner does not respond or cannot be contacted within 14 days of notification, the Sponsor reserves the right to select an alternative winner by random draw from the remaining eligible entries. The winner will also be announced on this page.
6. Prize Claim and Conditions
6.1. The winner may be required to provide additional documentation to verify their eligibility and independent professional status.
6.2. The winner agrees to participate in any reasonable publicity or promotional activities in connection with the Competition, subject to prior approval of the wording.
6.3. Scheduling of the videography service will be mutually agreed upon between the winner and the Sponsor, subject to availability.
6.4. Any costs or expenses not expressly included in the prize description remain the responsibility of the winner.
7. Data Collection and Privacy
7.1. By entering the Competition, entrants consent to the collection, use, and disclosure of their personal information by the Sponsor for administering the Competition and, where permitted, for future marketing communications.
7.2. Personal information will be handled in accordance with ProVision Australia’s Privacy Policy and all applicable privacy legislation.
8. General Conditions
8.1. ProVision Australia reserves the right to cancel, suspend, or modify the Competition at any time without notice if circumstances beyond its control warrant such action.
8.2. By entering, participants agree to be bound by these Terms and Conditions.
8.3. The Competition and these Terms and Conditions constitute the entire agreement between the entrant and ProVision Australia and supersede all previous or contemporaneous communications.
9. Limitation of Liability and Indemnity
9.1. ProVision Australia is not responsible for technical failures, human error, or any other factors that may prevent an entry from being received.
9.2. To the fullest extent permitted by law, ProVision Australia accepts no liability for any loss, damage, or injury arising from participation in the Competition or acceptance or use of the prize.
9.3. Entrants agree to indemnify and hold harmless ProVision Australia from any claims arising out of their participation in the Competition.
10. Dispute Resolution
10.1. Any disputes arising out of or connected with the Competition shall be governed by the laws of Australia and resolved in the appropriate courts of the relevant jurisdiction.
10.2. By entering the Competition, participants agree to submit to the exclusive jurisdiction of the courts in the relevant state or territory.
11. Permits, Registration, and Compliance
11.1. ProVision Australia is responsible for ensuring that the Competition complies with all relevant state and territory laws regarding games of chance.
11.2. Where required, ProVision Australia will secure all necessary permits or registrations prior to the launch of the Competition.
11.3. Any changes to regulatory requirements may necessitate amendments to these Terms and Conditions, and the Sponsor reserves the right to update them accordingly.
12. Acceptance of Terms
12.1. By participating in the Competition, entrants confirm that they have read, understood, and agreed to be bound by these Terms and Conditions.
12.2. Any breach of these Terms and Conditions may result in disqualification from the Competition.
